Article L2315-44 of the French Labour Code

In the absence of an agreement as provided for in Articles L. 2315-41 and L. 2315-42, the internal rules of procedure of the social and economic committee set out the arrangements referred to in 1° to 6° of Article L. 2315-41.

In the absence of an agreement under Article L. 2315-43, the employer may set the number and scope of one or more health, safety and working conditions committees. The internal rules of procedure of the social and economic committee define the procedures referred to in 1° to 6° of Article L. 2315-41.

En l’absence d’accord prévu aux articles L. 2315-41 et L. 2315-42, le règlement intérieur du comité social et économique définit les modalités mentionnées aux 1° à 6° de l’article L. 2315-41.


En l’absence d’accord prévu à l’article L. 2315-43, l’employeur peut fixer le nombre et le périmètre de mise en place d’une ou plusieurs commissions santé, sécurité et conditions de travail. Le règlement intérieur du comité social et économique définit les modalités mentionnées aux 1° à 6° de l’article L. 2315-41.
