Article L2321-10 of the French Labour Code

The works council defined in this title may be set up in undertakings belonging to an economic and social unit. The agreement defined in article L. 2321-2 is concluded either at the level of one or more undertakings making up the economic and social unit, or at the level of the economic and social unit. In the latter case, the rules governing the validity of the agreement are assessed by taking into account the votes validly cast in all the undertakings.

Le conseil d’entreprise défini au présent titre peut être mis en place dans les entreprises appartenant à une unité économique et sociale. L’accord défini à l’article L. 2321-2 est conclu soit au niveau d’une ou de plusieurs entreprises composant l’unité économique et sociale, soit au niveau de l’unité économique et sociale. Dans ce dernier cas, les règles de validité de l’accord sont appréciées en tenant compte des suffrages valablement exprimés dans l’ensemble des entreprises.
