Article L2342-11 of the French Labour Code

Where, instead of setting up a European Works Council, the special negotiating body opts for the establishment of one or more information and consultation procedures, the agreement shall lay down the arrangements by which the employees’ representatives may meet in order to carry out a consultation on the information communicated to them and which relates, in particular, to transnational issues significantly affecting the interests of the employees.

Lorsque, au lieu de créer un comité d’entreprise européen, le groupe spécial de négociation opte pour l’institution d’une ou de plusieurs procédures d’information et de consultation, l’accord prévoit selon quelles modalités les représentants des salariés peuvent se réunir pour procéder à une consultation sur les informations qui leur sont communiquées et qui portent, notamment, sur des questions transnationales affectant considérablement les intérêts des salariés.
