Article L2343-1 of the French Labour Code

A European Works Council shall be established in accordance with the provisions of this chapter in the following cases:

1° Where the head of the Community-scale undertaking or dominant undertaking refuses to set up a special negotiating body or to open negotiations within six months of receipt of the request provided for in Article L. 2342-4 ;

2° Where the special negotiating body has not concluded an agreement within three years of receipt of the request provided for in article L. 2342-4 or of the initiative taken by the company or group management, without prejudice to the provisions of article L. 2342-8.

The European Works Council is constituted and meets at the latest at the end of a period of six months following the expiry of the six-month or three-year terms mentioned in 1° and 2°.

Article L2343-1

Un comité d’entreprise européen est institué conformément aux dispositions du présent chapitre dans les cas suivants :

1° Lorsque le chef de l’entreprise ou de l’entreprise dominante de dimension communautaire refuse de mettre en place un groupe spécial de négociation ou d’ouvrir des négociations dans un délai de six mois à compter de la réception de la demande prévue à l’article L. 2342-4 ;

2° Lorsque le groupe spécial de négociation n’a pas conclu d’accord dans un délai de trois ans à compter de la réception de la demande prévue à l’article L. 2342-4 ou de l’initiative prise par la direction de l’entreprise ou du groupe, sans préjudice des dispositions de l’article L. 2342-8.

Le comité d’entreprise européen est constitué et réuni au plus tard à l’expiration d’un délai de six mois suivant l’arrivée des termes de six mois ou de trois ans, mentionnés aux 1° et 2°.
