Article L2343-5 of the French Labour Code

The European Works Council is made up of :

1° The head of the undertaking or of the dominant undertaking in the Community-scale group, assisted by two persons of his choice in an advisory capacity;

2° Staff representatives from the establishments of the undertaking or undertakings making up the Community-scale group.

The head of the undertaking or of the dominant undertaking in the Community-scale group of undertakings and any other appropriate level of management are informed of the appointment of employee representatives to the European Works Council.

Article L2343-5

Le comité d’entreprise européen est composé :

1° Du chef de l’entreprise ou de l’entreprise dominante du groupe de dimension communautaire, assisté de deux personnes de son choix ayant voix consultative ;

2° De représentants du personnel des établissements de l’entreprise ou des entreprises constituant le groupe de dimension communautaire.

Le chef de l’entreprise ou de l’entreprise dominante du groupe d’entreprises de dimension communautaire et tout autre niveau de direction approprié sont informés de la désignation des représentants des salariés au comité d’entreprise européen.
