Article L2351-6 of the French Labour Code

Participation means the influence exercised by the body representing the employees or by the employees’ representatives on the affairs of a company in the following ways:

– either by exercising their right to elect or appoint certain members of the company’s supervisory or administrative body ;

– by exercising their right to recommend or oppose the appointment of some or all of the members of the company’s supervisory or administrative body.

On entend par participation l’influence exercée par l’organe représentant les salariés ou par les représentants des salariés sur les affaires d’une société sous les formes suivantes :

– soit en exerçant leur droit d’élire ou de désigner certains membres de l’organe de surveillance ou d’administration de la société ;

– soit en exerçant leur droit de recommander la désignation d’une partie ou de l’ensemble des membres de l’organe de surveillance ou d’administration de la société ou de s’y opposer.
