Article L2353-10 of the French Labour Code

Where there is no trade union organisation in the European Company whose registered office is in France, employee representatives on the European Company Works Council are elected directly in accordance with the rules applicable to the Social and Economic Committee.

The same applies when there is no trade union organisation in the establishment or company located in France and belonging to a European Company.

Lorsqu’il n’existe pas d’organisation syndicale dans la société européenne dont le siège social se trouve en France, les représentants du personnel au comité de la société européenne sont élus directement selon les règles applicables au comité social et économique.

Il en va de même lorsqu’il n’existe pas d’organisation syndicale dans l’établissement ou l’entreprise implanté en France et appartenant à une société européenne.
