Article L2353-25 of the French Labour Code

The secretary and the members of the European Company Committee and its Bureau are entitled to the time necessary for the performance of their duties up to a limit which, save in exceptional circumstances, may not exceed one hundred and twenty hours per year for each of them.

This time is considered as working time and is paid at the normal rate.

The manager of the European Company who wishes to contest the use made of the time thus allocated shall bring the matter before a court.

The time spent by the secretary and the members of the committee and its bureau at meetings of the European Company committee and at meetings of the bureau is not deducted from these one hundred and twenty hours.

Le secrétaire et les membres du comité de la société européenne et de son bureau disposent du temps nécessaire à l’exercice de leurs fonctions dans la limite d’une durée qui, sauf circonstances exceptionnelles, ne peut excéder cent vingt heures annuelles pour chacun d’entre eux.

Ce temps est considéré comme temps de travail et payé à l’échéance normale.

Le dirigeant de la société européenne qui entend contester l’usage fait du temps ainsi alloué saisit le juge judiciaire.

Le temps passé par le secrétaire et les membres du comité et de son bureau aux séances du comité de la société européenne et aux réunions du bureau n’est pas déduit de ces cent vingt heures.
