Article L2411-16 of the French General Code of Local Authorities

Where the syndicate commission has not been formed, the change of use or the sale of all or part of the property of the section is decided by the municipal council ruling by an absolute majority of the votes cast, after agreement by the majority of the electors of the section convened by the mayor within six months of the transmission of the municipal council’s deliberation.

In the absence of agreement from the majority of the section’s electors, the State representative in the department decides, by reasoned decree, on the change of use or sale.

Lorsque la commission syndicale n’est pas constituée, le changement d’usage ou la vente de tout ou partie des biens de la section est décidé par le conseil municipal statuant à la majorité absolue des suffrages exprimés, après accord de la majorité des électeurs de la section convoqués par le maire dans les six mois de la transmission de la délibération du conseil municipal.

En l’absence d’accord de la majorité des électeurs de la section, le représentant de l’Etat dans le département statue, par arrêté motivé, sur le changement d’usage ou la vente.
