Article L2421-14 of the French General Code of Local Authorities

Failing amicable agreement, the compensation that may be due pursuant to articles L. 2421-5, L. 2421-6, L. 2421-8, L. 2421-9, L. 2421-11 and L. 2421-13 are set as in matters of expropriation in the public interest.

They cover the direct and certain material loss suffered by the interested parties.

Preferential rights attached to rights in rem, which may encumber the suppressed rights of enjoyment, are carried over to the compensation set either amicably or by the court with jurisdiction in expropriation matters.

A défaut d’accord amiable, les indemnités pouvant être dues en application des articles L. 2421-5, L. 2421-6, L. 2421-8, L. 2421-9, L. 2421-11 et L. 2421-13 sont fixées comme en matière d’expropriation pour cause d’utilité publique.

Elles couvrent le préjudice matériel direct et certain subi par les intéressés.

Les droits de préférence attachés aux droits réels, grevant éventuellement les droits de jouissance supprimés, sont reportés sur l’indemnité fixée soit à l’amiable, soit par la juridiction compétente en matière d’expropriation.
