Article L2421-16 of the French General Code of Local Authorities

In all cases where the municipality grants a lease to a person who, on 4 January 1967, occupied or operated the property in question, that person is not entitled to any compensation other than that relating to the extinction of the right of enjoyment, if he or she held such a right, without prejudice to the total or partial offsetting of that compensation against the price of the lease.

If the interested party has already received compensation other than that relating to the extinction of the right of use, he shall return it prior to the conclusion of the lease.

Dans tous les cas où la commune consent une location à une personne qui, à la date du 4 janvier 1967, occupait ou exploitait le bien considéré, cette personne n’a droit à aucune indemnité autre que celle qui est afférente à l’extinction du droit de jouissance, si elle en était titulaire, sans préjudice de la compensation totale ou partielle de cette indemnité avec le prix de la location.

Si l’intéressé a déjà perçu une indemnité autre que celle qui est afférente à l’extinction du droit de jouissance, il la restitue préalablement à la conclusion de la location.
