Article L2421-4 of the French Labour Code

The procedure provided for in this sub-section also applies to an employee holding one of the following mandates:

1° Member of the special negotiating body and member of the European Works Council ;

2° Member of the special negotiating body and representative on the European Company Works Council;

2° bis Member of the special negotiating body and representative on the committee of the European Cooperative Society;

2° ter Member of the special negotiating body and representative on the committee of the company resulting from the cross-border merger;

3° Member of a joint committee on health, safety and working conditions in agriculture provided for in Article L. 717-7 of the French Rural and Maritime Fishing Code;

4° Staff representative of an external company, appointed to the health, safety and working conditions committee of an establishment comprising at least one classified facility on the list provided for in Article L. 515-36 of the Environment Code or mentioned in Article L. 211-2 of the Mining Code.

Article L2421-4

La procédure prévue à la présente sous-section s’applique également au salarié investi de l’un des mandats suivants :

1° Membre du groupe spécial de négociation et membre du comité d’entreprise européen ;

2° Membre du groupe spécial de négociation et représentant au comité de la société européenne ;

2° bis Membre du groupe spécial de négociation et représentant au comité de la société coopérative européenne ;

2° ter Membre du groupe spécial de négociation et représentant au comité de la société issue de la fusion transfrontalière ;

3° Membre d’une commission paritaire d’hygiène, de sécurité et des conditions de travail en agriculture prévue à l’article L. 717-7 du code rural et de la pêche maritime ;

4° Représentant du personnel d’une entreprise extérieure, désigné à la commission santé, sécurité et conditions de travail d’un établissement comprenant au moins une installation classée figurant sur la liste prévue à l’article L. 515-36 du code de l’environnement ou mentionnée à l’article L. 211-2 du code minier.
