Article L2421-9 of the French Labour Code

When the Labour Inspector receives a request for authorisation of a transfer, in application of article L. 2414-1, on the occasion of a partial transfer of an undertaking or establishment, he shall ensure that the employee is not the subject of a discriminatory measure.

If authorisation for the transfer is refused, the employer shall offer the employee a similar job with equivalent remuneration in another establishment or another part of the company.

Lorsque l’inspecteur du travail est saisi d’une demande d’autorisation de transfert, en application de l’article L. 2414-1, à l’occasion d’un transfert partiel d’entreprise ou d’établissement, il s’assure que le salarié ne fait pas l’objet d’une mesure discriminatoire.

Si l’autorisation de transfert est refusée, l’employeur propose au salarié un emploi similaire assorti d’une rémunération équivalente dans un autre établissement ou une autre partie de l’entreprise.
