Breaking the employment contract of an employee who is an elected member of the staff delegation to the social and economic committee, a candidate for the staff delegation to the social and economic committee, a former elected member of the staff delegation to the social and economic committee or an employee who has requested the organisation of elections to set up a social and economic committee, in disregard of the provisions relating to the administrative authorisation procedure set out in this book, is punishable by one year’s imprisonment and a fine of 3,750 euros.
Dismissal of a trade union representative or a former trade union representative on the social and economic committee, in breach of the provisions mentioned in the first paragraph, is punishable by the same penalties.
Transferring the employment contract of an elected member of the staff delegation on the social and economic committee or of a trade union representative on the social and economic committee involved in a partial transfer of an undertaking or establishment, in disregard of the provisions relating to the administrative authorisation procedure, is punishable by the same penalties.
