Breaking the employment contract of an employee who is a member of the special negotiating body or of an employee who is a member of the works council of the company resulting from the cross-border merger, in disregard of the provisions relating to the administrative authorisation procedure laid down in this Book, is punishable by one year’s imprisonment and a fine of 3,750 euros.
Any transfer of the employment contract of an employee referred to in the first paragraph who is included in a partial transfer of undertaking or establishment, in disregard of the provisions relating to the administrative authorisation procedure, is punishable by the same penalties.
