The economic interest group enjoys legal personality and full capacity from the date of its registration in the Trade and Companies Register, without this registration implying a presumption that the group is commercial. An economic interest group whose purpose is commercial may carry out, on a regular and principal basis, all commercial activities on its own behalf. It may hold a commercial lease.
Persons who have acted on behalf of an economic interest group in formation before it has acquired legal personality are jointly and severally liable, without limit, for the acts thus performed, unless the group, after having been duly formed and registered, takes over the commitments entered into. These commitments are then deemed to have been entered into from the outset by the grouping.
