Article L2511-7 of the French Public procurement code

The rules defined in Title II apply to public contracts which, on the one hand, are concluded by a contracting entity with an affiliated undertaking or by a body formed exclusively by several contracting entities with a view to carrying out one or more network operator activities with an undertaking affiliated to one of these contracting entities and, on the other hand, have the following characteristics:
1° Public service contracts where the affiliated undertaking has achieved, over the three years preceding the year in which the contract is awarded, at least 80% of its average turnover in services with the contracting entity or with other undertakings with which the latter is affiliated;
2° Public supply contracts where the affiliated undertaking has achieved at least 80% of its average turnover in supplies with the contracting entity or with other undertakings to which it is affiliated during the three years preceding the year in which the contract is awarded;
3° Public works contracts where the affiliated undertaking has achieved at least 80% of its average turnover in works with the contracting entity or with other undertakings to which it is affiliated during the three years preceding the year in which the contract is awarded.
Where the affiliated undertaking was created or began operating less than three years before the year in which the public contract is awarded, it may simply demonstrate, in particular by means of business projections, that it is likely to achieve its turnover under the conditions set out in 1°, 2° and 3° above.
When identical or comparable services, supplies or works are provided by more than one undertaking linked to the contracting entity, the percentage of 80% mentioned above is assessed by taking into account all the services, supplies or works provided by these undertakings.

Sont soumis aux règles définies au titre II les marchés publics qui, d’une part, sont conclus par une entité adjudicatrice avec une entreprise liée ou par un organisme exclusivement constitué par plusieurs entités adjudicatrices en vue de réaliser une ou plusieurs activités d’opérateur de réseaux avec une entreprise liée à l’une de ces entités adjudicatrices et, d’autre part, présentent les caractéristiques suivantes :
1° Les marchés publics de services lorsque l’entreprise liée a réalisé au cours des trois années précédant l’année de passation du marché au moins 80 % de son chiffre d’affaires moyen en matière de services avec l’entité adjudicatrice ou avec d’autres entreprises auxquelles celle-ci est liée ;
2° Les marchés publics de fournitures lorsque l’entreprise liée a réalisé au cours des trois années précédant l’année de passation du marché au moins 80 % de son chiffre d’affaires moyen en matière de fournitures avec l’entité adjudicatrice ou avec d’autres entreprises auxquelles celle-ci est liée ;
3° Les marchés publics de travaux lorsque l’entreprise liée a réalisé au cours des trois années précédant l’année de passation du marché au moins 80 % de son chiffre d’affaires moyen en matière de travaux avec l’entité adjudicatrice ou avec d’autres entreprises auxquelles celle-ci est liée.
Lorsque l’entreprise liée a été créée ou a commencé à exercer son activité moins de trois ans avant l’année de passation du marché public, elle peut se borner à démontrer, notamment par des projections d’activités, que la réalisation de son chiffre d’affaires dans les conditions prévues aux 1°, 2° et 3° ci-dessus est vraisemblable.
Lorsque des services, des fournitures ou des travaux, identiques ou comparables, sont fournis par plus d’une entreprise liée à l’entité adjudicatrice, le pourcentage de 80 % mentionné ci-dessus est apprécié en tenant compte de la totalité des services, des fournitures ou des travaux fournis par ces entreprises.
