Article L2511-9 of the French Public procurement code

The rules laid down in Title II shall apply to public contracts concluded by a body set up exclusively by contracting entities to carry out one or more of the activities of a network operator with one of these contracting entities and to public contracts concluded by a contracting entity with such a body where the following conditions are met:
1° The body has been set up to carry out its activity for a period of at least three years;
2° Under the terms of the body’s articles of association, the contracting entities that set it up are members of it for at least the period referred to in 1°.

Article L2511-9

Sont soumis aux règles définies au titre II les marchés publics conclus par un organisme constitué exclusivement par des entités adjudicatrices pour exercer une ou plusieurs des activités d’opérateur de réseaux avec l’une de ces entités adjudicatrices ainsi que les marchés publics conclus par une entité adjudicatrice avec un tel organisme lorsque les conditions suivantes sont réunies :
1° L’organisme a été constitué pour exercer son activité pendant une période d’au moins trois ans ;
2° Aux termes des statuts de cet organisme, les entités adjudicatrices qui l’ont constitué en sont membres au moins pendant la période mentionnée au 1°.
