Where the Superior Court of Arbitration annuls an arbitral award in whole or in part, it shall refer the case back to the parties who shall appoint a new arbitrator if they so agree.

If, following a new appeal, the new award is set aside by the Court, the Court shall appoint one of its rapporteurs to conduct a supplementary investigation.

Within fifteen days of the second annulment decision, the Court shall, after taking cognisance of the investigation and with the same powers as an arbitrator, make an arbitral award which may not be appealed.

Lorsque la cour supérieure d’arbitrage prononce l’annulation en tout ou partie d’une sentence arbitrale, elle renvoie l’affaire aux parties qui désignent, si elles en sont d’accord, un nouvel arbitre.

Lorsque, à la suite d’un nouveau pourvoi, la nouvelle sentence est annulée par la cour, celle-ci désigne l’un de ses rapporteurs pour procéder à une instruction complémentaire.

Elle rend, dans les quinze jours suivant le deuxième arrêt d’annulation, après avoir pris connaissance de l’enquête, et avec les mêmes pouvoirs qu’un arbitre, une sentence arbitrale qui ne peut faire l’objet d’aucun recours.
