Article L2544-8 of the French General Code of Local Authorities

Members of the municipal council who are interested in the enjoyment of the property and rights claimed by the section are not entitled to take part in municipal council deliberations relating to the dispute.

If, by application of this provision, the number of members of the town council entitled to take part in the deliberation is reduced to less than one third of its members, the councillors required to abstain are replaced by an equal number of inhabitants drawn by lot by the representative of the State in the department from among the persons registered on the electoral rolls of the commune and not belonging to the section.

Les membres du conseil municipal qui sont intéressés à la jouissance des biens et droits revendiqués par la section n’ont pas le droit de prendre part aux délibérations du conseil municipal relatives au litige.

Si, par application de cette disposition, le nombre des membres du conseil municipal ayant le droit de prendre part à la délibération est réduit à moins du tiers de ses membres, les conseillers tenus à l’abstention sont remplacés par un nombre égal d’habitants tirés au sort par le représentant de l’Etat dans le département parmi les personnes inscrites sur les listes électorales de la commune et n’appartenant pas à la section.
