Article L2573-26 of the French General Code of Local Authorities

I. – Articles L. 2224-1, L. 2224-2, L. 2224-4 to L. 2224-6 are applicable to the communes of French Polynesia subject to the provisions of II to VI.

II. – For the application of Article L. 2224-1, after the words: “leased or granted by the communes” are inserted the words:

“in accordance with the locally applicable provisions”.

III. – For the application of the eighth paragraph of Article L. 2224-2:

1° The words: “3,000 inhabitants” are replaced twice by the words: “10,000 inhabitants”;

2° The words: “and sanitation” are replaced by the words: “, sanitation, waste treatment and electricity”.

IV. – For the application of Article L. 2224-4, after the words: “leased or conceded”, the words: “in accordance with locally applicable provisions” are inserted.

V. – For the application of the third paragraph of Article L. 2224-5, the words: “under the conditions provided for in Article L. 1411-13” are replaced by the words: “on site at the town hall and, where applicable, at the annexed town hall, within fifteen days of this notice, by means of a poster affixed”.

VI. – For the application of article L. 2224-6, the words: “if the two services are subject to the same rules for liability to value added tax and” are deleted.

Article L2573-26

I. – Les articles L. 2224-1, L. 2224-2, L. 2224-4 à L. 2224-6 sont applicables aux communes de la Polynésie française sous réserve des dispositions prévues aux II à VI.

II. – Pour l’application de l’article L. 2224-1, après les mots : ” affermés ou concédés par les communes ” sont insérés les mots :

” conformément aux dispositions applicables localement “.

III. – Pour l’application du huitième alinéa de l’article L. 2224-2 :

1° Les mots : ” 3 000 habitants ” sont remplacés deux fois par les mots : ” 10 000 habitants ” ;

2° Les mots : ” et d’assainissement ” sont remplacés par les mots : “, d’assainissement, de traitement des déchets et d’électricité “.

IV. – Pour l’application de l’article L. 2224-4, après les mots : ” affermés ou concédés ” sont insérés les mots : ” conformément aux dispositions applicables localement “.

V. – Pour l’application du troisième alinéa de l’article L. 2224-5, les mots : ” dans les conditions prévues à l’article L. 1411-13 ” sont remplacés par les mots : ” sur place à la mairie et, le cas échéant, à la mairie annexe, dans les quinze jours qui suivent cet avis, par voie d’affiche apposée “.

VI. – Pour l’application de l’article L. 2224-6, les mots : ” si les deux services sont soumis aux mêmes règles d’assujettissement à la taxe sur la valeur ajoutée et ” sont supprimés.
