Article L2573-29 of the French General Code of Local Authorities

An easement is instituted for the benefit of the communes of French Polynesia, or their public establishments or public service concessionaires who undertake work to establish drinking water pipes or wastewater or rainwater drainage pipes, giving them the right to permanently establish underground pipes in private undeveloped land, except for courtyards and gardens adjoining dwellings.

The establishment of this easement entitles the holder to compensation.

A decree sets the terms and conditions for the application of this article, in order in particular to ensure that the conditions for exercising the easement are rational and the least harmful to the present and future use of the land.

Article L2573-29

Il est institué au profit des communes de Polynésie française, ou de leurs établissements publics ou des concessionnaires de services publics qui entreprennent des travaux d’établissement de canalisations d’eau potable ou d’évacuation d’eaux usées ou pluviales, une servitude leur conférant le droit d’établir à demeure des canalisations souterraines dans les terrains privés non bâtis, excepté les cours et jardins attenant aux habitations.

L’établissement de cette servitude ouvre droit à indemnité.

Un décret fixe les modalités d’application du présent article afin notamment que les conditions d’exercice de la servitude soient rationnelles et les moins dommageables à l’utilisation présente et future des terrains.
