An easement is instituted for the benefit of the communes of French Polynesia, or their public establishments or public service concessionaires who undertake work to establish drinking water pipes or wastewater or rainwater drainage pipes, giving them the right to permanently establish underground pipes in private undeveloped land, except for courtyards and gardens adjoining dwellings.
The establishment of this easement entitles the holder to compensation.
A decree sets the terms and conditions for the application of this article, in order in particular to ensure that the conditions for exercising the easement are rational and the least harmful to the present and future use of the land.
