Article L310-6-1 of the French Commercial code

The offences provided for in this title or in the texts adopted for its application are investigated and recorded by the agents mentioned in II of article L. 450-1, under the conditions provided for in articles L. 450-1, L. 450-2, L. 450-3, L. 450-7 and L. 450-8. The articles L. 521-1, L. 521-2 and L. 524-1 to L. 524-3 of the Consumer Code may be implemented on the basis of the findings made.

For these offences, the administrative authority responsible for competition and consumer affairs has the right, as long as the public prosecution has not been initiated, to reach a settlement, with the agreement of the public prosecutor, under the conditions set out in Article L. 490-5.

Les infractions prévues au présent titre ou par les textes pris pour son application sont recherchées et constatées par les agents mentionnés au II de l’article L. 450-1, dans les conditions prévues aux articles L. 450-1, L. 450-2, L. 450-3, L. 450-7 et L. 450-8. Les articles L. 521-1, L. 521-2 et L. 524-1 à L. 524-3 du code de la consommation peuvent être mis en œuvre à partir des constatations effectuées.

Pour ces infractions, l’autorité administrative chargée de la concurrence et de la consommation a droit, tant que l’action publique n’a pas été mise en mouvement, de transiger, après accord du procureur de la République, dans les conditions prévues à l’article L. 490-5.
