Article L3115-11 of the French Public Health Code

The following are determined by decree in the Conseil d’Etat:

1° Pursuant to the 2005 International Health Regulations:

a) The criteria for designating points of entry to the territory, particularly with regard to the scale of their international traffic and their even distribution across the territory ;

b) The criteria for defining serious or unusual health events that must be reported to the health authorities and the procedures for reporting these events;

c) The criteria for designating yellow fever vaccination centres, the conditions for the validity of yellow fever vaccination certificates and the procedures for checking these certificates on entry into the territory;

d) The criteria and conditions for authorising the agents mentioned in the fourth paragraph of Article L. 3115-1 ;

2° The conditions for approving the persons or organisations that may carry out the technical inspections mentioned in the second paragraph of Article L. 3115-1 and the procedures for issuing the corresponding certificates;

3° The conditions for applying Article L. 3115-7, in particular the procedures for communicating information relating to any public health risks identified to passengers or customers, the criteria for defining serious health risks and the conditions for communicating data enabling passengers to be identified;

4° The conditions under which the medical service at a point of entry may carry out healthcare activities and under which Articles L. 162-32 to L. 162-32-3 of the Social Security Code apply.

Article L3115-11

Sont déterminés par décret en Conseil d’Etat :

1° En application du Règlement sanitaire international de 2005 :

a) Les critères de désignation des points d’entrée du territoire, notamment en ce qui concerne l’importance de leur trafic international et leur répartition homogène sur le territoire ;

b) Les critères de définition des événements sanitaires graves ou inhabituels devant être déclarés aux autorités sanitaires et les modalités de déclaration de ces événements ;

c) Les critères de désignation des centres de vaccination antiamarile, les conditions de validité des certificats de vaccination antiamarile et les modalités de contrôle de ces certificats lors de l’entrée sur le territoire ;

d) Les critères et les conditions d’habilitation des agents mentionnés au quatrième alinéa de l’article L. 3115-1 ;

2° Les conditions d’agrément des personnes ou organismes pouvant réaliser les contrôles techniques mentionnés au deuxième alinéa de l’article L. 3115-1 et les modalités de délivrance des certificats correspondants ;

3° Les conditions d’application de l’article L. 3115-7, notamment les modalités de communication des informations relatives aux risques pour la santé publique constatés aux passagers ou aux clients, les critères de définition du risque sanitaire grave et les conditions de communication des données permettant l’identification des passagers ;

4° Les conditions dans lesquelles le service médical d’un point d’entrée peut réaliser des activités de soins et dans lesquelles s’appliquent les articles L. 162-32 à L. 162-32-3 du code de la sécurité sociale.
