Victims of losses resulting from contamination by the human immunodeficiency virus caused by a transfusion of blood products or an injection of blood-derived products carried out on the territory of the French Republic are compensated under the conditions defined below.
The present procedure is not precluded by a clause releasing the claimant from all proceedings and actions against a third party in respect of his or her contamination.
Full compensation for the losses defined in the first paragraph is provided by the Office national d’indemnisation des accidents médicaux, des affections iatrogènes et des infections nosocomiales mentioned in article L. 1142-22. A Steering Committee, composed in particular of representatives of the associations concerned, is attached to the Board of Directors of the Office.
The persons who have access to the documents and information provided to the Office are bound by professional secrecy, under the conditions and penalties set out in articles 226-13 and 226-14 of the French Penal Code.
