Article L313-21-1 of the French Monetary and Financial Code

Companies selected to contribute to the creation of activities or the development of jobs within the framework of an agreement signed with the State in application of articles L. 1233-84 to L. 1233-89 of the Labour Code as well as companies approved by the Minister for the Economy are authorised to grant partial guarantees to credit institutions or finance companies granting loans for business development projects located in employment areas experiencing economic difficulties or revealing economic fragility, as well as to craft mutual guarantee companies which guarantee such projects.

The conditions for application of these provisions, particularly with regard to approval and the extent of guarantees, are set by decree in the Conseil d’Etat.

Article L313-21-1

Les sociétés retenues pour contribuer à la création d’activités ou au développement des emplois dans le cadre d’une convention passée avec l’Etat en application des articles L. 1233-84 à L. 1233-89 du code du travail ainsi que les sociétés agréées par le ministre chargé de l’économie sont autorisées à consentir des garanties partielles au profit d’établissements de crédit ou de sociétés de financement octroyant des prêts pour des projets de développement d’entreprises situées dans des bassins d’emploi connaissant des difficultés économiques ou révélant une fragilité économique, ainsi qu’aux sociétés de caution mutuelle artisanales qui cautionnent de tels projets.

Les conditions d’application de ces dispositions, notamment en ce qui concerne l’agrément et l’étendue des garanties, sont fixées par décret en Conseil d’Etat.
