Article L313-9 of the French Monetary and Financial Code

The provisions of the second and third paragraphs of article 3-1 of decree no. 53-960 of 30 September 1953 (1), as amended and supplemented by law no. 65-356 of 12 May 1965, do not apply to property leasing contracts.

Under penalty of nullity, such contracts shall stipulate the conditions under which they may be terminated at the lessee’s request.

Les dispositions des deuxième et troisième alinéas de l’article 3-1 du décret n° 53-960 du 30 septembre 1953 (1) modifié et complété par la loi n° 65-356 du 12 mai 1965, ne sont pas applicables aux contrats de crédit-bail immobilier.

Ces contrats prévoient, à peine de nullité, les conditions dans lesquelles leur résiliation pourra, le cas échéant, intervenir à la demande du preneur.
