Banque de France officials commissioned by the Minister for the Economy and the officials referred to in articles L. 511-3 and L. 511-21 of the Consumer Code are authorised, in the course of their duties, to investigate and record breaches of the provisions of articles L. 312-1-1, L. 312-1-2, L. 314-12, L. 314-13 and L. 315-6 to L. 315-8 of this Code.
The authorised officials mentioned in the first paragraph are also responsible for investigating and recording breaches of the provisions of articles L. 312-1-1, L. 312-1-2, L. 314-12, L. 314-13 and L. 315-6 to L. 315-8 committed by the agents and branches of payment service providers having their registered office or central administration in another Member State of the European Union or party to the Agreement on the European Economic Area established in mainland France, Guadeloupe, French Guiana, Martinique, Reunion Island, Mayotte or Saint-Martin.
These officers may enter any premises used for business purposes and request the disclosure of books and any other business documents and take copies thereof, and obtain information and evidence by summons or on site. They may only enter these premises between eight o’clock in the morning and eight o’clock at night. If the person in charge of the premises objects, the visit may only take place with the authorisation of the public prosecutor of the judicial court in whose jurisdiction the premises are located. Professional secrecy may not be invoked against officers acting within the scope of the powers conferred upon them by this article.
In the case of offences punishable under criminal law, reports are forwarded to the public prosecutor within five days of being drawn up. In all cases, a copy of the report is given to the person concerned.
