To be able to carry out the activity of voluntary sales of furniture by public auction on a temporary and occasional basis, a national of a Member State of the European Union or of another State party to the Agreement on the European Economic Area must provide evidence in the declaration referred to in Article L. 321-24 that he is legally established in one of these States, that he is not subject to any even temporary ban on practising and that he holds the professional qualifications required, where applicable, in the Member State of origin.
However, if this activity or the training leading to it is not regulated in the State in which he is established, the service provider must prove that he has practised this activity in one or more Member States of the European Union or parties to the Agreement on the European Economic Area, for at least one year on a full-time basis or on a part-time basis for an equivalent total period, during the ten years prior to providing the service. In the case of a legal entity, the declaration must show that its managers, partners or employees include a person who fulfils these conditions.
