Article L321-37 of the French Commercial code

With the exception of disputes relating to voluntary sales by public auction of wholesale goods, which are brought before the commercial courts, the civil courts alone have jurisdiction to hear legal actions relating to sales activities in which an operator of voluntary sales of furniture by public auction mentioned in Article L. 321-4. Any clause to the contrary is deemed unwritten. Nevertheless, if the operator is a legal entity, the partners may agree, in the articles of association, to submit to arbitrators any disputes arising between them or between voluntary sales operators as a result of their activity.

A l’exception des contestations relatives aux ventes volontaires aux enchères publiques de marchandises en gros, qui sont portées devant les tribunaux de commerce, les tribunaux civils sont seuls compétents pour connaître des actions en justice relatives aux activités de vente dans lesquelles est partie un opérateur de ventes volontaires de meubles aux enchères publiques mentionné à l’article L. 321-4. Toute clause contraire est réputée non écrite. Néanmoins, si l’opérateur est une personne morale, les associés peuvent convenir, dans les statuts, de soumettre à des arbitres les contestations qui surviendraient entre eux ou entre opérateurs de ventes volontaires à raison de leur activité.
