Only persons meeting the conditions mentioned in 1° to 3° of I of article L. 321-4 are authorised to direct the sale, to designate the last bidder as the successful bidder or to declare the property not awarded and to draw up the minutes of this sale.
The minutes are drawn up no later than one clear day after the close of the sale. It shall mention the name and address of the new owner declared by the successful bidder, the identity of the seller, the description of the item and its publicly recorded price.
Goods declared not awarded at the end of the auction may be sold by mutual agreement, at the request of the owner of the goods or his representative, by the voluntary sales operator who organised the sale by public auction. Unless otherwise stipulated by an amendment to the mandate subsequent to this sale, this transaction may not be carried out at a price lower than the last bid made before the property was withdrawn from the sale or, in the absence of bids, the amount of the reserve price. The last bidder is informed in advance if known. It is recorded in a document attached to the sale minutes.
