Article L3211-1 of the French Public Health Code

A person may not, without his consent or, where appropriate, without the authorisation of his legal representative, if he is a minor, or that of the person responsible for his protection, if he is an adult subject to a legal protection measure with representation relating to the person, be the subject of psychiatric care, except in the cases provided for in Chapters II to IV of this Title and those provided for inArticle 706-135 of the Code of Criminal Procedure.

All persons undergoing psychiatric care or their families have the right to contact the practitioner or mental health team, public or private, of their choice both within and outside the psychiatric sector corresponding to their place of residence.

Une personne ne peut sans son consentement ou, le cas échéant, sans l’autorisation de son représentant légal, si elle est mineure, ou celle de la personne chargée de la protection, s’il s’agit d’un majeur faisant l’objet d’une mesure de protection juridique avec représentation relative à la personne, faire l’objet de soins psychiatriques, hormis les cas prévus par les chapitres II à IV du présent titre et ceux prévus à l’article 706-135 du code de procédure pénale.

Toute personne faisant l’objet de soins psychiatriques ou sa famille dispose du droit de s’adresser au praticien ou à l’équipe de santé mentale, publique ou privée, de son choix tant à l’intérieur qu’à l’extérieur du secteur psychiatrique correspondant à son lieu de résidence.
