Article L3211-12-5 of the French Public Health Code

When a full hospitalisation measure is released in application of V of article L. 3211-12-1, the patient may, as soon as the measure is released, be subject to psychiatric care in the form mentioned in 2° of I of article L. 3211-2-1 if the conditions provided for in I of articles L. 3212-1 or L. 3213-1 are still met and in accordance with the procedures provided for, respectively, in chapters II or III of this title.

In this case, a care programme is drawn up in accordance with article L. 3211-2-1. The initial observation and care period referred to in article L. 3211-2-2 does not apply.

Article L3211-12-5

Lorsque la mainlevée d’une mesure d’hospitalisation complète est acquise en application du V de l’article L. 3211-12-1, le patient peut, dès cette mainlevée, faire l’objet de soins psychiatriques sous la forme mentionnée au 2° du I de l’article L. 3211-2-1 si les conditions prévues au I des articles L. 3212-1 ou L. 3213-1 sont toujours réunies et selon les modalités prévues, respectivement, aux chapitres II ou III du présent titre.

Dans ce cas, un programme de soins est établi en application de l’article L. 3211-2-1. La période d’observation et de soins initiale mentionnée à l’article L. 3211-2-2 n’est pas applicable.
