Article L3211-3 of the French General Code of Local Authorities

A departmental council or, by concurring deliberation, several departmental councils may submit proposals to amend or adapt legislative or regulatory provisions, in force or in the process of being drawn up, concerning the powers, organisation and operation of one, several or all of the departments. These proposals may concern the differentiation, referred to in Article L. 1111-3-1, of the rules relating to the allocation and exercise of powers applicable to the départements, in order to take account of differences in situations.

Proposals adopted by the departmental councils in application of the first paragraph of this article are forwarded by the departmental council presidents to the Prime Minister, the representative of the State in the departments concerned and, when they concern legislative provisions, to the presidents of the National Assembly and the Senate.

Article L3211-3

Un conseil départemental ou, par délibérations concordantes, plusieurs conseils départementaux peuvent présenter des propositions tendant à modifier ou à adapter des dispositions législatives ou réglementaires, en vigueur ou en cours d’élaboration, concernant les compétences, l’organisation et le fonctionnement d’un, de plusieurs ou de l’ensemble des départements. Ces propositions peuvent porter sur la différenciation, mentionnée à l’article L. 1111-3-1, des règles relatives à l’attribution et à l’exercice des compétences applicables aux départements, afin de tenir compte des différences de situations.

Les propositions adoptées par les conseils départementaux en application du premier alinéa du présent article sont transmises par les présidents de conseil départemental au Premier ministre, au représentant de l’Etat dans les départements concernés et, lorsqu’elles portent sur des dispositions législatives, aux présidents de l’Assemblée nationale et du Sénat.

Le Premier ministre accuse réception des propositions qui lui sont transmises. Un rapport annuel indique les suites qui ont été données à ces propositions. Ce rapport est rendu public.
