Article L3211-5-1 of the French Public Health Code

Except with the authorisation of the court, it is forbidden, on pain of nullity, for anyone holding an office or employment in an establishment providing psychiatric care to acquire property or transfer a right belonging to a person admitted to the establishment or to lease accommodation occupied by that person prior to his admission to the establishment.

For the purposes of this article, the spouse, partner in a civil solidarity pact, cohabitee, ascendants and descendants of persons to whom the above-mentioned prohibitions apply are deemed to be interposed persons.

Sauf autorisation de justice, il est interdit, à peine de nullité, à quiconque exerce une fonction ou occupe un emploi dans un établissement dispensant des soins psychiatriques de se rendre acquéreur d’un bien ou cessionnaire d’un droit appartenant à une personne admise dans l’établissement ou de prendre à bail le logement occupé par cette personne avant son admission dans l’établissement.

Pour l’application du présent article, sont réputées personnes interposées, le conjoint, le partenaire d’un pacte civil de solidarité, le concubin, les ascendants et les descendants des personnes auxquelles s’appliquent les interdictions ci-dessus édictées.
