Article L3212-8 of the French Public Health Code

Without prejudice to the provisions mentioned in article L. 3212-7, the care measure taken in application of article L. 3212-1 or article L. 3212-3 is terminated as soon as a psychiatrist from the establishment certifies that the conditions which justified this measure are no longer met and makes a note of this in the register provided for in article L. 3212-11. This detailed certificate must mention the evolution or disappearance of the disorders that justified the care.

Within twenty-four hours of the end of the care measure, the director of the establishment informs the representative of the State in the department or, in Paris, the police prefect, the commission mentioned in article L. 3222-5 and the person who requested the care.

Sans préjudice des dispositions mentionnées à l’article L. 3212-7, il est mis fin à la mesure de soins prise en application de l’article L. 3212-1 ou de l’article L. 3212-3 dès qu’un psychiatre de l’établissement certifie que les conditions ayant motivé cette mesure ne sont plus réunies et en fait mention sur le registre prévu à l’article L. 3212-11. Ce certificat circonstancié doit mentionner l’évolution ou la disparition des troubles ayant justifié les soins.

Dans les vingt-quatre heures qui suivent la fin de la mesure de soins, le directeur de l’établissement en informe le représentant de l’Etat dans le département ou, à Paris, le préfet de police, la commission mentionnée à l’article L. 3222-5 et la personne qui a demandé les soins.
