The director of an establishment referred to in Article L. 3222-1 is liable to six months’ imprisonment and a fine of €7,500 if he or she:
1° Admit a person to psychiatric care pursuant to 1° of II of article L. 3212-1 without having obtained the request for admission to care and the medical certificates provided for by the same 1° ;
2° Admitting a person to psychiatric care in application of 2° of the same II without having the medical certificate provided for by the same 2° ;
3° Failing to send to the State representative in the department or, in Paris, to the Préfet de Police, within the prescribed deadlines, the admission decision, the medical certificates and the entry form drawn up in application of I of article L. 3212-5 ;
4° Failing to send to the representative of the State in the department or, in Paris, to the Préfet de Police, within the prescribed time limits, the medical certificates drawn up pursuant to 1° and 2° of I of article L. 3213-1 and article L. 3213-3 ;
5° Failing to comply with the requirements of article L. 3212-11 and of IV of article L. 3213-1 relating to the keeping and presentation of registers within the specified time limit;
6° Failing to notify the representative of the State in the département or, in Paris, the Préfet de Police of the medical certificate provided for in article L. 3213-9-1 within the time limit specified in that article.
