The President of the Departmental Council is solely responsible for administration. He may delegate by decree, under his supervision and responsibility, the exercise of part of his functions to the vice-presidents. He may also delegate part of his duties, under the same conditions, to members of the departmental council in the absence or impediment of the vice-presidents or when they all hold a delegation. These delegations remain in force until they are withdrawn.
A member of the departmental council who has ceased his duties as chairman of the departmental council pursuant to Articles L. 2122-4 or L. 4133-3 may not receive a delegation until the end of their term of office as a departmental councillor or until the termination of the office that placed them in a situation of incompatibility.
Members of the departmental council holding a mandate as a deputy, senator or representative in the European Parliament may not receive or retain a delegation.
The president of the departmental council is the head of the department’s services. He may, under his supervision and responsibility, delegate his signature in all matters to the heads of the said departments.
