I.-When a request for a person to be admitted for psychiatric care has been submitted under the conditions provided for in 1° of II of article L. 3212-1 or when an imminent danger to the person’s health has been established under the conditions provided for in 2° of the same II, the State representative will, with a view to admitting the person into psychiatric care, issue an order for the person’s transfer to a facility located in Saint-Martin, Guadeloupe or Martinique and authorised to treat people suffering from mental disorders in accordance with locally applicable regulations.
II – Similarly, the State representative will issue a health transfer order for a person whose mental disorder requires treatment and compromises his or her safety or that of other people, or seriously undermines public order.
III – The reasons for the transfer order are given in the detailed medical certificate(s) stating that the person concerned has a mental disorder requiring care with constant or regular supervision in an establishment authorised to treat people with mental disorders. In addition, where appropriate, reasons are given in the light of the report drawn up by the police authorities establishing the risk of harm to personal safety and public order.
