Article L3312-1 of the French General Code of Local Authorities

Within a period of two months prior to the examination of the budget, the President of the Departmental Council presents a report to the Departmental Council on the budget guidelines for the financial year, the multiannual commitments envisaged, the structure and development of expenditure and staff numbers, and the structure and management of the debt. In particular, this report sets out the forecast development and implementation of staff costs, remuneration, benefits in kind and working hours. The report is sent to the representative of the State in the department, published and discussed by the departmental council, which takes note of it in a specific resolution. The content of the report and the procedures for its publication are laid down by decree.

The draft budget of the department is prepared and presented by the president of the departmental council, who is required to communicate it to the members of the departmental council, together with the corresponding reports, at least twelve days before the opening of the first meeting devoted to consideration of the said budget.

The initial budget, the supplementary budget and the amending decisions are voted on by the departmental council.

Dans un délai de deux mois précédant l’examen du budget, le président du conseil départemental présente au conseil départemental un rapport sur les orientations budgétaires de l’exercice, les engagements pluriannuels envisagés, la structure et l’évolution des dépenses et des effectifs ainsi que sur la structure et la gestion de la dette. Ce rapport précise notamment l’évolution prévisionnelle et l’exécution des dépenses de personnel, des rémunérations, des avantages en nature et du temps de travail. Il fait l’objet d’une transmission au représentant de l’Etat dans le département, d’une publication et d’un débat au conseil départemental, dont il est pris acte par une délibération spécifique. Le contenu du rapport et les modalités de sa publication sont fixés par décret.

Le projet de budget du département est préparé et présenté par le président du conseil départemental qui est tenu de le communiquer aux membres du conseil départemental avec les rapports correspondants, douze jours au moins avant l’ouverture de la première réunion consacrée à l’examen dudit budget.

Le budget primitif, le budget supplémentaire et les décisions modificatives sont votés par le conseil départemental.
