I.-A fine of €3,750 shall be imposed for knowingly undermining, for purposes other than research, an effective technological measure as defined in article L. 331-5, in order to alter the protection of a work by decoding, decrypting or any other personal intervention intended to circumvent, neutralise or remove a protection or control mechanism, where this infringement is carried out by means other than the use of a technological application, device or existing component mentioned in II.
II.-It is punishable by six months’ imprisonment and a fine of 30,000 euros to knowingly procure or offer to others, directly or indirectly, means designed or specially adapted to infringe an effective technological measure as defined in article L. 331-5, by one of the following processes:
1° By manufacturing or importing a technological application, device or component, for purposes other than research;
2° By holding with a view to sale, loan or hire, by offering for the same purposes or by making available to the public in any form whatsoever a technological application, device or component ;
3° By providing a service for this purpose;
4° By inciting the use of or ordering, designing, organising, reproducing, distributing or disseminating advertising in favour of one of the processes referred to in 1° to 3°.
III.-These provisions do not apply to acts carried out for computer security purposes, within the limits of the rights provided for in this Code.
