Article L3425-2 of the French Public Health Code

Failure to comply with the decision ordering a therapeutic injunction is punishable by the penalties provided for in articles L. 3421-1 and L. 3425-1.

However, these penalties are not applicable when the therapeutic injunction constitutes a specific obligation imposed on a person who has been sentenced to a term of imprisonment suspended on probation or suspended with an obligation to perform community service.

Le fait de se soustraire à l’exécution de la décision ayant ordonné une injonction thérapeutique est puni des peines prévues aux articles L. 3421-1 et L. 3425-1.

Toutefois, ces sanctions ne sont pas applicables lorsque l’injonction thérapeutique constitue une obligation particulière imposée à une personne qui a été condamnée à une peine d’emprisonnement assortie du sursis probatoire ou du sursis assorti de l’obligation d’accomplir un travail d’intérêt général.
