Infringement of the rights of the database producer may be proven by any means.
To this end, any person entitled to act under this title shall be entitled to have any bailiffs, assisted by experts appointed by the plaintiff, carry out, upon an order made on request by the competent civil court, either a detailed description, with or without the taking of samples, of the media or products allegedly infringing the rights of the database producer, or the actual seizure of such media or products together with any documents relating thereto.
The court may order, for the same evidentiary purposes, the detailed description or actual seizure of the equipment and instruments used to produce or distribute the media or products allegedly infringing the rights of the database producer, as well as any document relating thereto.
The order may authorise the actual seizure of any document relating to the media, products, materials and instruments mentioned in the second and third paragraphs in the absence of the latter.
The court may make the execution of the measures it orders subject to the provision by the plaintiff of guarantees intended to ensure the possible indemnification of the defendant if the action brought under this title is subsequently found to be unfounded or if the seizure is released.
The release of the seizure may be ordered in accordance with the procedures set out in articles L. 332-2and L. 332-3.
