Article L3441-5 of the French General Code of Local Authorities

International agreements relating both to areas of State competence and to areas of departmental competence are, in cases where the first paragraph of articles L. 3441-3 and L. 3441-4-1 is not applied, negotiated and signed by the authorities of the Republic. At its request, the president of the departmental council or his representative takes part, as part of the French delegation, in the negotiation of these agreements.

The presidents of the overseas departmental councils, or their representatives, shall participate, within the French delegation, at their request, in negotiations with the European Union concerning their department.

The presidents of the overseas departmental councils may ask the State to initiate negotiations with the European Union with a view to obtaining specific measures useful to the development of their territory.

Les accords internationaux portant à la fois sur des domaines de compétence de l’Etat et sur des domaines de compétence du département sont, dans les cas où il n’est pas fait application du premier alinéa des articles L. 3441-3 et L. 3441-4-1, négociés et signés par les autorités de la République. A sa demande, le président du conseil départemental ou son représentant participe, au sein de la délégation française, à la négociation de ces accords.

Les présidents des conseils départementaux d’outre-mer, ou leurs représentants, participent, au sein de la délégation française, à leur demande, aux négociations avec l’Union européenne intéressant leur département.

Les présidents des conseils départementaux d’outre-mer peuvent demander à l’Etat de prendre l’initiative de négociations avec l’Union européenne en vue d’obtenir des mesures spécifiques utiles au développement de leur territoire.
