Article L3515-6 of the French Public Health Code

Legal entities held criminally liable, under the conditions set out in article 121-2 of the French Penal Code, for the offences defined in articles L. 3515-3 and L. 3515-4, in addition to the fine, the maximum rate of which is defined in accordance with the procedures set out in article 131-38 of the French Penal Code, are liable to:

1° The suppression, removal or confiscation of the prohibited advertising at the offenders’ expense;

2° In the event of a repeat offence, a ban, for a period of up to five years, on the sale of the products that were the subject of the illegal operation.

In the event of prosecution, the cessation of advertising may be ordered either at the request of the public prosecutor or ex officio by the examining magistrate or the court hearing the case. The measure thus taken is enforceable notwithstanding any means of appeal. It may be lifted by the court that ordered it or that is seized of the case. The measure ceases to have effect in the event of a decision to dismiss or acquit.

Decisions on applications for release may be appealed to the Investigating Chamber or to the Court of Appeal, depending on whether they were handed down by an investigating judge or by the court hearing the case.

Article L3515-6

Les personnes morales déclarées responsables pénalement, dans les conditions prévues par l’article 121-2 du code pénal, des infractions définies aux articles L. 3515-3 et L. 3515-4, encourent, outre l’amende dont le taux maximum est défini suivant les modalités prévues par l’article 131-38 du code pénal :

1° La suppression, l’enlèvement ou la confiscation de la publicité interdite aux frais des délinquants ;

2° En cas de récidive, l’interdiction, pendant une durée inférieure ou égale à cinq ans, de la vente des produits qui ont fait l’objet de l’opération illégale.

En cas de poursuites, la cessation de la publicité peut être ordonnée soit sur réquisition du ministère public, soit d’office par le juge d’instruction ou le tribunal saisi des poursuites. La mesure ainsi prise est exécutoire nonobstant toutes voies de recours. Mainlevée peut en être donnée par la juridiction qui l’a ordonnée ou qui est saisie du dossier. La mesure cesse d’avoir effet en cas de décision de non-lieu ou de relaxe.

Les décisions statuant sur les demandes de mainlevée peuvent faire l’objet d’un recours devant la chambre de l’instruction ou devant la cour d’appel selon qu’elles ont été prononcées par un juge d’instruction ou par le tribunal saisi des poursuites.
