Article L352-7 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a foreign national who has been refused entry to French territory on the basis of asylum lodges an appeal for annulment on the basis of article L. 352-4 in the last four days of the period of detention in the waiting area set by the last detention decision, this period is automatically extended by four days from the lodging of the appeal. This decision is recorded in the register provided for in the second paragraph of article L. 341-2 and brought to the attention of the public prosecutor under the conditions set out in the same article. The liberty and custody judge is informed immediately of this extension. He may terminate it.

Lorsqu’un étranger dont l’entrée sur le territoire français au titre de l’asile a été refusée dépose un recours en annulation sur le fondement de l’article L. 352-4 dans les quatre derniers jours de la période de maintien en zone d’attente fixée par la dernière décision de maintien, celle-ci est prorogée d’office de quatre jours à compter du dépôt du recours. Cette décision est mentionnée sur le registre prévu au second alinéa l’article L. 341-2 et portée à la connaissance du procureur de la République dans les conditions prévues au même article. Le juge des libertés et de la détention est informé immédiatement de cette prorogation. Il peut y mettre un terme.
