The judgement of the president of the administrative court or the judge designated by him may be appealed within fifteen days to the president of the territorially competent administrative court of appeal or a judge designated by the latter. This appeal does not have suspensive effect.
If the refusal of entry on the grounds of asylum and, where applicable, the transfer decision are annulled, the foreign national’s stay in the waiting area is immediately terminated and he or she is authorised to enter France on a regularisation visa for a period of eight days. Within this period, the competent administrative authority shall, at his request, issue him with the asylum application certificate enabling him to lodge his asylum application with the French Office for the Protection of Refugees and Stateless Persons.
The decision to refuse entry on the grounds of asylum and, where applicable, the transfer decision which have not been contested within the period provided for in the first paragraph or which have not been cancelled under the conditions provided for in this article may be automatically enforced by the administrative authority.
