Article L361-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book in Guadeloupe, French Guiana, Martinique, Réunion, Mayotte and Saint-Pierre-et-Miquelon:
1° Unless otherwise provided, references to Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) and to the Schengen Borders Code are deleted;
2° 2° of Article L. 311-2 does not apply;
3° In Article L. 312-1, the words: “in Article 6 of Regulation 2016/399 of the European Parliament and of the Council of 9 March 2016” and the words: “by Chapters II and III of Title III of Regulation No 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas” are replaced by the words: “by the international conventions and regulations in force”;
4° Article L. 312-7 is not applicable;
5° In Article L. 313-1, the words: “, and constitutes the document provided for by the convention signed in Schengen on 19 June 1990 to justify the conditions of residence in the case of a family or private visit” are deleted;
6° In article L. 313-2, the words: “or for a period of three months from the entry of the foreign national into the territory of the States party to the convention signed in Schengen on 19 June 1990” are deleted;
7° Article L. 331-1 is not applicable;
8° In Article L. 331-2, the words: “external borders” and the words: “in Chapter II of Title II of Regulation 2016/399 of the European Parliament and of the Council of 9 March 2016” are replaced respectively by the words: “borders” and by the words: “by the international conventions and regulations in force”;
9° Article L. 331-3 is not applicable;
10° Article L. 332-3 is not applicable;
11° 1° of Article L. 351-1 is not applicable;
12° 1° of Article L. 352-1 shall not apply;
13° In Article L. 352-2, the words: “Except where the examination of the asylum application falls within the jurisdiction of another State,” are deleted;
14° In Article L. 352-4, the words: “and, where applicable, a transfer decision referred to in Article L. 572-1” and the words: “and, where applicable, against the transfer decision” are deleted;
15° In Article L. 352-8, the words: “and, where applicable, the transfer decision may not be enforced” are replaced by the words: “may not be enforced”;
16° In Article L. 352-9, the words: “and, where applicable, the transfer decision are annulled” are replaced by the words: “is annulled” and the words: “and, where applicable, the transfer decision which have not been contested” are replaced by the words: “which has not been contested”.

Pour l’application du présent livre en Guadeloupe, en Guyane, en Martinique, à La Réunion, à Mayotte et à Saint-Pierre-et-Miquelon :
1° Sauf dispositions contraires, les références au règlement (UE) 2016/399 du Parlement européen et du Conseil du 9 mars 2016 concernant un code de l’Union relatif au régime de franchissement des frontières par les personnes (code frontières Schengen) et au code frontières Schengen sont supprimées ;
2° Le 2° de l’article L. 311-2, n’est pas applicable ;
3° A l’article L. 312-1, les mots : ” à l’article 6 du règlement 2016/399 du Parlement européen et du Conseil du 9 mars 2016 ” et les mots : ” par les chapitres II et III du titre III du règlement n° 810/2009 du Parlement européen et du Conseil du 13 juillet 2009 établissant un code communautaire des visas ” sont remplacés par les mots : ” par les conventions internationales et les règlements en vigueur ” ;
4° L’article L. 312-7 n’est pas applicable ;
5° A l’article L. 313-1, les mots : “, et constitue le document prévu par la convention signée à Schengen le 19 juin 1990 pour justifier les conditions de séjour dans les cas d’une visite familiale ou privée ” sont supprimés ;
6° A l’article L. 313-2, les mots : ” ou pendant une durée de trois mois à compter de l’entrée de l’étranger sur le territoire des Etats parties à la convention signée à Schengen le 19 juin 1990 ” sont supprimés ;
7° L’article L. 331-1 n’est pas applicable ;
8° A l’article L. 331-2, les mots : ” frontières extérieures ” et les mots : ” au chapitre II du titre II du règlement 2016/399 du Parlement européen et du Conseil du 9 mars 2016 ” sont respectivement remplacés par les mots : ” frontières ” et par les mots : ” par les conventions internationales et les règlements en vigueur ” ;
9° L’article L. 331-3 n’est pas applicable ;

11° Le 1° de l’article L. 351-1 n’est pas applicable ;
