The attending doctor is authorised to inform the sentence enforcement judge or the probation officer of the interruption of treatment, without being bound by the provisions of article 226-13 of the Criminal Code. When the attending doctor informs the judge or probation officer, he will immediately inform the coordinating doctor.

If treatment is refused or interrupted against the advice of the attending doctor, the latter shall immediately inform the coordinating doctor who shall immediately inform the sentence enforcement judge, in compliance with the provisions relating to medical confidentiality. If the coordinating doctor is unavailable, the attending doctor may inform the sentence enforcement judge directly of the refusal or interruption of treatment against his advice.

The attending physician may also inform the coordinating physician of any difficulties encountered in carrying out the treatment, who is authorised, under the same conditions as in the previous paragraph, to inform the sentence enforcement judge or the probation officer.

The attending physician may also propose that the sentence enforcement judge order a medical examination.

The attending physician may prescribe any treatment indicated for the care of the convicted offender, including libido inhibiting medication.

Le médecin traitant est habilité, sans que puissent lui être opposées les dispositions de l’article 226-13 du code pénal, à informer le juge de l’application des peines ou l’agent de probation de l’interruption du traitement. Lorsque le médecin traitant informe le juge ou l’agent de probation, il en avise immédiatement le médecin coordonnateur.

Lorsque le refus ou l’interruption du traitement intervient contre l’avis du médecin traitant, celui-ci le signale sans délai au médecin coordonnateur qui en informe immédiatement, dans le respect des dispositions relatives au secret médical, le juge de l’application des peines. En cas d’indisponibilité du médecin coordonnateur, le médecin traitant peut informer directement le juge de l’application des peines du refus ou de l’interruption du traitement intervenu contre son avis.

Le médecin traitant peut également informer de toutes difficultés survenues dans l’exécution du traitement le médecin coordonnateur qui est habilité, dans les mêmes conditions qu’à l’alinéa précédent, à prévenir le juge de l’application des peines ou l’agent de probation.

Le médecin traitant peut également proposer au juge de l’application des peines d’ordonner une expertise médicale.

Le médecin traitant peut prescrire tout traitement indiqué pour le soin du condamné y compris des médicaments inhibiteurs de libido.
