Article L3824-2 of the French Public Health Code

In the event of imminent danger to the patient’s health or to the safety of persons, as attested by a medical opinion, the higher administrator of the Wallis and Futuna Islands shall take all provisional measures necessary for the supervision of a person whose behaviour reveals manifest mental disorder with a view to his/her possible transfer to an establishment located in New Caledonia or French Polynesia and authorised to treat persons suffering from mental disorder in accordance with locally applicable regulations. Under no circumstances may the patient be taken to a prison. Restrictions on the exercise of personal freedoms are limited to those required by the patient’s state of health.

En cas de danger imminent pour la santé du malade ou pour la sûreté des personnes, attesté par un avis médical, l’administrateur supérieur des îles Wallis et Futuna prend toutes les mesures provisoires nécessaires à la surveillance d’une personne dont le comportement révèle des troubles mentaux manifestes en vue de son éventuel transfert sanitaire à destination d’un établissement situé en Nouvelle-Calédonie ou en Polynésie française et habilité à soigner les personnes atteintes de troubles mentaux conformément à la réglementation localement applicable. En aucun cas, le malade ne peut être conduit dans un local relevant de l’administration pénitentiaire. Les restrictions à l’exercice de ses libertés individuelles se limitent à celles nécessitées par son état de santé.
